Court denies Avid Telecom's bid to dismiss robocall lawsuit

On May 10, 2024, Michigan Attorney General Dana Nessel announced that the United States District Court in Arizona rejected Avid Telecom’s multiple attempts to dismiss and delay a bipartisan lawsuit. The suit, brought forward by 49 attorneys general who are members of the Anti-Robocall Multistate Litigation Task Force, was against Michael D. Lansky, L.L.C., doing business as Avid Telecom, its owner Michael D. Lansky and its vice-president, Stacey S. Reeves.

The lawsuit was initiated in May 2023 and accuses Avid Telecom of initiating and facilitating billions of illegal robocalls to millions of people across the nation. “Michigan consumers deserve relief from intrusive, illegal robocalls,” Nessel said. “I’m glad the Court rejected Avid’s attempts to dismiss and delay this litigation from moving forward, and we are one step closer to holding accountable companies who knowingly route illegal robocalls through their networks.”

Avid Telecom is alleged to have sent or attempted to transmit more than 24 billion scam calls over a four-year period about Social Security Administration scams, Medicare scams, auto warranty scams, Amazon scams, DirecTV scams, credit card interest rate reduction scams, and employment scams. The company reportedly continued transmitting these calls even after being notified at least 329 times that these illegal robocalls were being sent across their networks.
