Michigan Attorney General Dana Nessel has lodged a complaint against Daniel Courtemanche, the 68-year-old owner and operator of the Ugly RV Park in Pinconning. The complaint, filed in the 30th Judicial Circuit Court in Ingham County, alleges that Courtemanche violated state laws by operating a campground without a preconstruction permit and license. He is also accused of installing and using non-compliant wastewater lagoons and creating a public nuisance.
Nessel stated, “Unpermitted campgrounds with non-compliant wastewater systems can pollute groundwater and threaten the health of an entire community, and violators must be held accountable.” She went on to commend the Michigan Department of Environment, Great Lakes, and Energy (EGLE) for their efforts to protect the environment and stand against those who risk public health.
According to the Department's allegations, Courtemanche had contacted EGLE in 2020 seeking guidance on the permitting process for campgrounds. Despite receiving clear instructions, he allegedly proceeded to construct and operate the Ugly RV Park without obtaining a preconstruction permit or license. These are both requirements under Part 125 of the Public Health Code. Furthermore, it is alleged that improperly engineered and constructed wastewater lagoons at the Ugly RV Park discharge raw sewage into groundwater.
Eric Oswald, director of EGLE’s Drinking Water and Environmental Health Division (DWEHD), said: “We cannot turn a blind eye to the wanton disregard of the legal safeguards in place to protect public health.” He added that when these safeguards are repeatedly ignored, action must be taken against those who flout the law.
In 2022, following complaints from the Bay County Health Department, EGLE issued a cease-and-desist order and violation notice to Courtemanche. However, despite communications between EGLE and Courtemanche, it is alleged that violations were not addressed. As such, Courtemanche continues to operate the Ugly RV Park without a license or proper wastewater lagoons.
The complaint seeks injunctive relief, civil fines, and costs. Courtemanche is due to appear before Judge Wanda M. Stokes in the 30th Judicial Circuit Court in Ingham County on June 6.
