Joseph Willbee, a 50-year-old resident of Torch Lake, was arraigned in Lansing's 54A District Court on September 9. He faces three counts of filing false or fraudulent income tax returns, each carrying a potential five-year prison sentence. The charges are connected to allegations that Willbee failed to report income from an illegal marijuana cultivation and distribution operation in Otsego County between 2019 and 2021.
Authorities executed a search warrant at Willbee’s home and related facilities in October 2021. According to officials, they found over 1,000 marijuana plants and more than 50 pounds of processed marijuana. The Michigan State Police’s Marijuana and Tobacco Investigation Section referred the case to the Attorney General’s office.
“Large-scale illegal marijuana operations deprive our state of revenue that funds critical services,” said Michigan Attorney General Dana Nessel. “I appreciate the efforts of the Michigan State Police’s Marijuana and Tobacco Investigation Section. My office will continue to hold accountable those who attempt to skirt their tax obligations.”
Willbee is scheduled for his next court appearance before Judge Stacia Buchanan on September 18.
Officials reminded the public that criminal charges are only allegations, and defendants are presumed innocent until proven guilty. The Department does not release booking photos.
