Michigan Attorney General Dana Nessel has initiated legal action against Hummingbird Construction Co., LLC and its owner, Matthew Ashline. The lawsuit, filed in Washtenaw County Circuit Court, accuses the company of taking deposits for construction projects that were never started and failing to refund customers. The case alleges violations of the Michigan Consumer Protection Act and seeks to dissolve the company while requiring repayment to affected customers.

According to Attorney General Nessel, Ashline accepted deposits from clients in St. Clair, Monroe, Eaton, and Washtenaw Counties but did not commence the agreed-upon work. Customers reportedly faced delays or no refunds despite requesting their money back.

One customer paid an $8,000 deposit in July 2024 for roof and porch repairs that were never initiated. A refund was received only after a police complaint was filed months later. Another client deposited $7,000 in February 2025 for a roof replacement with no work done or funds returned.

Other similar cases include payments of $5,000 made in January and April 2025 for porch and roof work that did not occur. Additionally, Hummingbird allegedly collected $162,000 this year for constructing a new home but has delayed it without issuing refunds.

“Construction projects are a major investment," Nessel stated. "Contractors cannot take thousands of dollars in deposits and then disappear." She emphasized holding accountable those who exploit residents under the Consumer Protection Act.

Attorney General Nessel also reissued her consumer alert advising on building and remodeling practices. She urged consumers to resist high-pressure sales tactics and verify contractor licenses through the Bureau of Professional Licensing's website.

Nessel recommended obtaining multiple written estimates for services, checking consumer complaints with relevant authorities like the Better Business Bureau or Attorney General's Consumer Protection Team, securing references and contracts with clear terms including payment arrangements as parts of jobs are completed using fraud-protected credit cards instead of cash.

Consumers can file complaints regarding licensed contractors with Michigan’s Department of Licensing & Regulatory Affairs' Bureau of Professional Licensing; unlicensed contractor issues should be reported there or locally due to potential criminal law violations.

Complaints about non-licensed contractors can be directed towards both the Attorney General's Consumer Protection Team as well as Better Business Bureau if licensing isn’t mandatory yet still
