Attorney General Nessel seeks stricter penalties for Texas man violating robocall bans

Michigan Attorney General Dana Nessel has requested the U.S. District Court for the Southern District of Texas to take stricter measures against John Caldwell Spiller II for violating permanent bans on robocalls and telemarketing. This action follows a judgment from March 2023, which involved seven other state attorneys general who were part of the original case against Spiller. The lawsuit accused him of directing billions of illegal robocalls nationwide, with Michigan alone receiving over 42 million in 2019.

“Mr. Spiller has completely ignored and connived to circumvent the existing court orders preventing him from operating as a robocaller in Michigan,” stated Nessel. "So, we are asking the Court to strike decisively against his capacities to harass people all across the country with his deceptive robocalls.”

The previous judgments prohibited Spiller from making robocalls or engaging in telemarketing activities. Despite this injunction, he allegedly continued these practices using aliases and falsified business records filed across various states and with the Federal Communications Commission. Furthermore, since being sued, Spiller reportedly established at least three new businesses to continue facilitating robocalls.

In response to these violations, Nessel and her colleagues are urging the court to extend the ban on Spiller's involvement in any telephone-related services beyond just robocalling and telemarketing. This includes restrictions on transmitting calls over U.S. networks, providing VoIP services, text messaging services, and originating or facilitating ringless voicemail messages.

The attorneys general have also requested that Spiller be ordered to dissolve his current telephone service companies and pay $122,339,320—the amount initially suspended under conditions he failed to meet per the permanent injunction.

Nessel is joined by Attorneys General from Arkansas, Indiana, Missouri, North Carolina, North Dakota, Ohio, and Texas in filing this motion.
