Irene Oluwatoyin Oshiyoye has agreed to pay $250,000 to settle allegations that she defrauded the Medicare and Medicaid programs. The settlement was announced by United States Attorney Jerome F. Gorgon Jr. and resolves claims that Oshiyoye submitted, or caused to be submitted, false claims for home health visits performed by unlicensed and unsupervised foreign doctors through Advance Visiting Physicians, P.C., which she operated with her late husband, Dr. Adekunle Oshiyoye.
The alleged fraudulent activity took place between January 1, 2018, and December 31, 2021. Advance Visiting Physicians provided home health care services in Southeast Michigan from its Farmington Hills office during this period.
The case was brought under the qui tam provisions of the False Claims Act, allowing private individuals to file actions on behalf of the government and potentially receive a portion of any recovery. The qui tam case is titled United States and the State of Michigan ex rel. Telusnor v. Advance Visiting Physicians, P.C., et al., Case No. 2:20-cv-12602 (E.D. Mich.). The amount of the settlement and its payment terms were determined based on Oshiyoye’s financial situation.
Multiple agencies participated in investigating and resolving the matter, including the FBI, U.S. Department of Health and Human Services - Office of the Inspector General, the United States Attorney’s Office for the Eastern District of Michigan, and the Michigan Attorney General Health Care Fraud Division. Assistant United States Attorney Anthony Gentner managed the case for the U.S. Attorney’s Office.
